Boughton Lawyers Present on Kerr v Daniel Leather Inc.

November 1, 2007 - Boughton Law Corporation's Securities and Securities Litigation Groups' members made up a panel regarding the Kerr v. Daniel decision released by the Supreme Court of Canada on October 12th. Heather Craig, Claudia Losie, and Gregg Rafter presented their analysis of the case at the Canadian Institute's Intensive Course on Securities Law and Practice on October 30, 2007.

The group presented the legal ramifications of the decision and provided their views of the practical impact for issuers in British Columbia.

The Supreme Court of Canada's decision restored issuers' understanding of their disclosure requirements under the Provincial Securities Legislation and, at the same time, gave comfort to regulators by determining that the business judgement rule had no place in Statutory Disclosures.
