Gordon Fulton practices litigation, primarily in the regulation of public utilities, commercial litigation and estate litigation. He is counsel to the provincial public utilities regulator and has acted as commission counsel on a wide variety of matters, including revenue requirements, rate design, the disposition of utility assets and certificate of public convenience and necessity applications such as the Vancouver Island Generation Project and the Vancouver Island Transmission Reinforcement Project.
He is rated as a leading lawyer by LEXPERT and has been selected by his peers to be included in the 2010 edition of The Best Lawyers in Canada in the specialty of Energy Regulatory Law.
Mr. Fulton has extensive experience in cases involving the interpretation of contracts, breach of contract, breach of fiduciary duty, negligence and unjust enrichment. He has successfully defended a claim for unjust enrichment brought by a Formula 1 Team and most recently he successfully defended a manufacturer of large commercial equipment at trial and on appeal against claims for breach of contract and negligence.
His experience in estate litigation includes acting as trial and appellate counsel in cases involving the variation of wills and trusts and the interpretation of testamentary and trust documents. He was counsel for the Public Guardian and Trustee in the two leading cases involving the interpretation of a section of the Patient's Property Act .
